Your copyright lasts for 70 years after death, so if you would like the benefit of your copyright to go to someone of your choice, say a family member, it is important that this instruction is included in your will.

If you do not leave a will your estate is considered intestate and will be distributed to your next of kin in accordance with the rules of intestacy applying in the relevant State or Territory. If you leave a will but it does not specify who will receive your copyright, it will be distributed along with the “residue” or remainder of the estate among the beneficiaries of that residue.

These principles also apply to the resale royalty right which lasts for 70 years after death.
